Terms and Conditions

Online store Numoco.pl EFFECTIVE

1. These Terms and Conditions define the general conditions, rules and method of sales conducted by DONACO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (DONACO LIMITED LIABILITY COMPANY) with its registered office in Racibórz, through the online store www.numoco.pl (hereinafter referred to as: "Online Store") and define the rules and conditions for the provision by DONACO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Racibórz of free electronic services.

§ 1 Definitions

1. Business days - means weekdays from Monday to Friday excluding public holidays.

2. Delivery - means the actual activity consisting in delivering to the Customer by the Seller, through the Supplier, the Product specified in the order.

3. Supplier - means a courier company with which the Seller cooperates in the scope of Product Delivery.

4. Password - means a sequence of letters, digits or other characters selected by the Customer during the first login to the Online Store, used to secure access to the Customer Account in the Online Store.

5. Customer - means an entity for whom, in accordance with the Terms and Conditions and legal provisions, electronic services may be provided or with whom a Sales Agreement may be concluded.

6. Consumer - means a natural person performing a legal act with an entrepreneur not directly related to their business or professional activity.

7. Customer Account - means an individual panel for each Customer, launched for them by the Seller, after the Customer has completed Registration and concluded a Customer Account service agreement.

8. Terms and Conditions - means these terms and conditions.

9. Registration - means the actual activity performed in the manner specified in the Terms and Conditions, required for the Customer to use all functionalities of the Online Store.

10. Seller - means DONACO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Racibórz (47-400), ul. Bartka Lasoty 19, Tax ID: 5252459775, REGON: 141960446, entered in the register of entrepreneurs kept by the District Court in Gliwice, 10th Commercial Division of the National Court Register under number KRS 0000334643, with share capital of PLN 10,000; e-mail: biuro@numoco.com, being also the owner of the Online Store.

11. Store Website - means the websites under which the Seller operates the Online Store, operating in the domain www.numoco.pl.

12. Product - means a product presented by the Seller through the Store Website, which may be the subject of a Sales Agreement.

13. Durability - the ability of the Product to maintain its functions and properties during normal use.

14. Durable medium - means material or tool enabling the Customer or Seller to store information addressed personally to them, in a way that allows access to information in the future for a period appropriate to the purposes served by this information, and which allows reproduction of stored information in unchanged form.

15. Sales Agreement - means a distance sales agreement concluded on the terms specified in the Terms and Conditions, between the Customer and the Seller.

§ 2 General Provisions and Use of the Online Store

1. All rights to the Online Store, including proprietary copyrights, intellectual property rights to its name, its internet domain, Store Website, as well as to patterns, forms, logos placed on the Store Website (except for logos and photos presented on the Store Website for the purpose of presenting products, to which copyrights belong to third parties) belong to the Seller, and their use may only take place in the manner specified and in accordance with the Terms and Conditions and with the written consent of the Seller.

Minimum technical requirements: web browser Microsoft Edge 109, Internet Explorer 11, Chrome 110, FireFox 109, Opera 95, Safari 11 or newer, with Javascript support enabled, accepting "cookies" files and internet connection with bandwidth of at least 256 kbit/s. Website optimized for resolution 1024x768 pixels.

3. The Seller uses a "cookies" file mechanism, which during Customers' use of the Store Website, are saved by the Seller's server on the hard drive of the Customer's end device. Each Customer can disable the "cookies" mechanism in the web browser of their end device. Disabling "cookies" may, however, cause difficulties or make it impossible to use the Store Website.

4. In order to place an order in the Online Store through the Store Website and to use electronic services provided through the Store Website, it is necessary for the Customer to have an active email account.

5. It is forbidden for the Customer to provide unlawful content and to use the Online Store, Store Website or free services provided by the Seller in a manner contrary to law, good morals or infringing personal rights of third parties.

6. The Seller declares that the public nature of the Internet and the use of electronic services may involve the risk of obtaining and modifying Customer data by unauthorized persons, therefore Customers should use appropriate technical measures that will minimize the above-mentioned risks.

7. It is not permissible to use the resources and functions of the Online Store for conducting activities by the Customer that would violate the Seller's interests.

§ 3 Registration

1. In order to create a Customer Account, the Customer is obliged to complete free Registration.

2. Registration is necessary to place an order in the Online Store.

3. For Registration purposes, the Customer should fill out the registration form provided by the Seller on the Store Website and send the completed registration form electronically to the Seller by selecting the appropriate function located in the registration form. During Registration, the Customer sets an individual Password.

4. While filling out the registration form, the Customer has the opportunity to familiarize themselves with the Terms and Conditions, accepting their content by marking the appropriate field in the form.

5. After sending the completed registration form, the Customer receives immediately, electronically to the email address provided in the registration form, confirmation of Registration by the Seller. At this moment, an agreement for the electronic provision of Customer Account service is concluded, and the Customer gains access to the Customer Account and the ability to make changes to the data provided during Registration.

§ 4 Orders

1. Information contained on the Store Website does not constitute an offer from the Seller within the meaning of the Civil Code, but only an invitation to Customers to submit offers for concluding a Sales Agreement.

2. The Customer can place orders in the Online Store through the Store Website 7 days a week, 24 hours a day.

3. The Customer placing an order through the Store Website completes the order by selecting the Product they are interested in. Adding the Product to the order is done by selecting the "ADD TO CART" command under the given Product presented on the Store Website. After completing the entire order and indicating in the "CART" the Delivery method and payment form, the Customer places the order by sending the order form to the Seller, selecting the "BUY AND PAY" button on the Store Website.

4. Placing an order constitutes the Customer's submission of an offer to the Seller to conclude a Sales Agreement for Products that are the subject of the order.

5. After placing an order, the Seller sends to the email address provided by the Customer confirmation of its placement.

6. Then, after confirming the order placement, the Seller sends to the email address provided by the Customer information about accepting the order for processing. Information about accepting the order for processing is the Seller's declaration of accepting the offer and upon its receipt by the Customer, the Sales Agreement is concluded.

7. After concluding the Sales Agreement, the Seller confirms its terms to the Customer, sending them on a Durable medium, to the Customer's email address or in writing to the address indicated by the Customer when placing the order.

§ 5 Payments

1. Prices on the Store Website posted for a given Product constitute gross prices and do not include information regarding Delivery costs and any other costs that the Customer will be obliged to bear in connection with the Sales Agreement, about which the Customer will be informed when choosing the Delivery method and placing the order.

Available payment methods:

  • bank transfer to the Seller's bank account
  • payment card, bank transfer or BLIK through the przelewy24.pl system (PayPro S.A.)
  • payment card or bank transfer through the PayPal system
  • cash on delivery - payment to the Supplier when making Delivery

3. The Customer should make payment for the order in the amount resulting from the concluded Sales Agreement within 7 Business days if they chose the prepayment form.

4. In case of the Customer's failure to pay on time, the Seller sets an additional deadline for the Customer to make payment and informs them about it on a Durable medium. In case of ineffective expiry of the second deadline for payment, the Seller will send the Customer on a Durable medium a statement of withdrawal from the agreement based on Art. 491 of the Civil Code.

§ 6 Delivery

1. The Seller performs Delivery on the territory of the Republic of Poland.

2. The Seller is obliged to deliver the Product in accordance with the Sales Agreement.

3. The Seller posts on the Store Website information about the number of Business days needed for Delivery and order processing.

4. The Delivery and order processing time indicated on the Store Website is counted in Business days.

5. Ordered Products are delivered to the Customer through the Supplier to the address indicated in the order form.

6. On the day of sending the Product to the Customer, information confirming the dispatch of the shipment by the Seller is sent to the Customer's email address.

7. The Customer is obliged to examine the delivered shipment at the time and in the manner accepted for shipments of a given type. If shortage or damage to the shipment is found, the Customer has the right to request the Supplier's employee to draw up an appropriate protocol.

8. The Seller sends to the Customer's email address provided in the order form a purchase receipt covering the delivered Products, in the form of an electronic file in PDF format. The purchase receipt is also available to the Customer in the Customer Account after logging in.

9. In case of the Customer's absence at the address indicated by them, provided when placing the order as the Delivery address, the Supplier's employee will leave a notice or attempt telephone contact to establish a time when the Customer will be present.

§ 7 Non-conformity of goods with the contract

The Product is in conformity with the contract if the following remain in conformity:

  • description, type, quantity, quality, completeness and functionality
  • suitability for a special purpose about which the Consumer notified the Seller
  • for goods with digital elements – compatibility, interoperability and availability of updates

2. Furthermore, for the Product to be considered conforming to the contract, it must be suitable for the purposes for which Products of this type are usually used, taking into account applicable legal provisions, technical standards or good practices.

4. The Seller is liable for lack of conformity of the Product with the contract existing at the time of its delivery and revealed within two years from that time, unless the period of suitability of the Product for use, determined by the Seller, their legal predecessors or persons acting on their behalf, is longer.

6. If the Product is not in conformity with the contract, the Consumer may demand its repair or replacement.

9. The Seller performs repair or replacement within a reasonable time from the moment the Seller was informed by the Consumer about the lack of conformity with the contract, and without excessive inconvenience to the Consumer. The costs of repair or replacement are borne by the Seller.

The Consumer may withdraw from the contract or demand a price reduction when:

  • The Seller refused to bring the Product into conformity with the contract
  • The Seller did not bring the Product into conformity with the contract
  • lack of conformity of the Product with the contract persists despite repair attempts
  • lack of conformity is so significant that it justifies withdrawal from the contract

13. The Seller is obliged to respond to the consumer's complaint within 14 days from the date of its receipt.

17. In case of withdrawal from the contract, the Consumer immediately returns the Product to the Seller at their cost. The Seller returns the price to the Consumer immediately, no later than within 14 days from the date of receiving the Product or proof of its return.

§ 8 Withdrawal from Sales Agreement by Consumer

1. The Customer who concluded a Sales Agreement may withdraw from it within 14 days without giving a reason.

2. The period for withdrawal from the Sales Agreement begins from the moment the Product is taken into possession by the Customer or a third party indicated by them other than the carrier.

3. The Customer may withdraw from the Sales Agreement by submitting a withdrawal statement to the Seller. This statement may be submitted:

  • in writing to the address: DONACO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Bartka Lasoty 19 (47-400), Racibórz
  • via email to the address: biuro@numoco.com
  • using the form available on the Store Website

6. The Seller is obliged immediately, no later than within 14 days from the date of receiving the Customer's statement of withdrawal from the Sales Agreement, to return all payments made by them, including the cost of Product Delivery to the Customer. The Seller may withhold the refund of payments received from the Customer until receiving the Product back or providing proof of its return by the Customer.

7. If the Customer exercising the right of withdrawal chose a Product delivery method other than the cheapest ordinary Delivery method offered by the Seller, the Seller is not obliged to refund the additional costs incurred by the Customer.

8. The Customer is obliged to return the Product to the Seller immediately, but no later than within 14 days from the day they withdrew from the Sales Agreement. To meet the deadline, it is sufficient to send the Product to the Seller's address before the expiry of this deadline.

9. In case of withdrawal, the Customer bears only the direct costs of return.

11. The Customer is liable for diminution in value of the Product resulting from use other than what is necessary to establish the nature, characteristics and functioning of the Product.

12. The Seller makes the refund using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different refund method that does not involve any costs for them.

§ 9 Free Services

The Seller provides the following free services:

  • Contact form
  • Newsletter
  • Customer Account management

2. The services indicated above are provided 7 days a week, 24 hours a day.

4. The Newsletter service can be used by any Customer who enters their email address, using the registration form provided by the Seller on the Store Website. After sending the completed registration form, the Customer receives immediately, electronically to the email address provided in the registration form, an activation link to confirm signing up for the Newsletter subscription.

5. The Newsletter service consists of sending by the Seller, to the email address, messages in electronic form containing information about new products or services in the Seller's offer.

7. The Customer can resign from receiving the Newsletter at any time by unsubscribing via the link included in each electronic message sent as part of the Newsletter service or by deactivating the appropriate field in the Customer Account.

10. The Customer may submit a complaint to the Seller in connection with the use of free electronic services provided by the Seller. The complaint may be submitted in electronic form and sent to the address biuro@numoco.com. The Seller considers complaints immediately, but no later than within 14 days and provides the Customer with a response.

§ 10 Personal Data Protection

1. The principles of Personal Data protection are included in the Privacy Policy.

§ 11 Contract Termination (does not apply to Sales Agreements)

1. Both the Customer and the Seller may terminate the electronic service agreement at any time and without giving reasons, with the reservation of maintaining rights acquired by the other party before termination of the aforementioned agreement and the provisions below.

2. The Seller terminates the electronic service agreement by sending the Customer an appropriate declaration of will to the email address provided by the Customer when using the service.

§ 12 Final Provisions

1. The content of these Terms and Conditions may be recorded by printing, saving on a medium or downloading at any time from the Store Website.

2. In case of a dispute arising on the basis of the concluded Sales Agreement, the parties will strive to resolve the matter amicably. The law applicable to resolving all disputes arising on the basis of these Terms and Conditions is Polish law.

3. The Seller reserves the right to change these Terms and Conditions. Changes to the Terms and Conditions take effect within 7 days from the date of publication on the Store Website. The Seller will inform the Customer 7 days before the new Terms and Conditions take effect about the change by sending an electronic message.

4. Agreements with the Seller are concluded in Polish language.

5. The Terms and Conditions take effect from July 20, 2025.

§ 1 General Provisions

1. This Privacy Policy defines the principles of processing personal data obtained through the online store www.numoco.pl (hereinafter referred to as: "Online Store").

2. The owner of the Online Store and at the same time the data controller is DONACO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (DONACO LIMITED LIABILITY COMPANY) with its registered office in Racibórz (47-400), ul. Bartka Lasoty 19, entered in the register of entrepreneurs of the National Court Register kept by the District Court in Gliwice, 10th Commercial Division of the National Court Register under number KRS 0000334643, with share capital of PLN 10,000, Tax ID: 5252459775, REGON: 141960446, hereinafter referred to as DONACO SP. Z O.O.

3. Personal data collected by DONACO SP. Z O.O. through the Online Store is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), also known as GDPR.

4. DONACO SP. Z O.O. takes particular care to respect the privacy of Customers visiting the Online Store.

§ 2 Types of Processed Data, Purposes and Legal Basis

1. DONACO SP. Z O.O. collects information regarding natural persons performing legal acts not directly related to their business activity, natural persons conducting business or professional activity in their own name, and natural persons representing legal persons or organizational units that are not legal persons but have legal capacity under the law, hereinafter collectively referred to as Customers.

Personal data of Customers is collected in the case of:

  • account registration in the Online Store, for the purpose of creating an individual account and managing that account. Legal basis: necessity to perform the account service agreement (Art. 6(1)(b) GDPR)
  • placing an order in the Online Store, for the purpose of performing the sales agreement. Legal basis: necessity to perform the sales agreement (Art. 6(1)(b) GDPR)
  • newsletter subscription, for the purpose of performing an agreement for services provided electronically. Legal basis - consent of the data subject to perform the Newsletter service agreement (Art. 6(1)(a) GDPR)
  • using the contact form service in the Online Store for the purpose of performing an agreement for services provided electronically. Legal basis: necessity to perform the contact form service agreement (Art. 6(1)(b) GDPR)

Scope of collected data:

In case of account registration in the Online Store, the Customer provides:

  • email address
  • first and last name
  • phone number

In case of placing an order in the Online Store, the Customer provides the following data:

  • email address
  • address data: postal code and city, country (state), street with house/apartment number
  • first and last name

In case of Entrepreneurs, the above scope of data is additionally extended to include:

  • company name of the Entrepreneur
  • Tax ID number

Technical data: When using the Online Store Website, additional information may be collected, in particular: IP address assigned to the Customer's computer or external IP address of the Internet provider, domain name, browser type, access time, operating system type.

§ 3 To Whom Data is Disclosed or Entrusted and How Long is it Stored?

1. Customer's personal data is transferred to service providers used by DONACO SP. Z O.O. in operating the Online Store.

Data Processors:

DONACO SP. Z O.O. uses providers who process personal data exclusively on the instructions of DONACO SP. Z O.O. These include, among others, providers offering hosting services, accounting services, providing marketing systems, systems for analyzing traffic in the Online Store, systems for analyzing the effectiveness of marketing campaigns.

Controllers:

DONACO SP. Z O.O. uses providers who independently determine the purposes and methods of using Customers' personal data. They provide electronic payment and banking services.

Data retention periods:

  • Data based on consent: until consent is withdrawn, and then for the limitation period of claims (6 years, for business activity - 3 years)
  • Data based on contract: until contract performance, and then for the limitation period of claims

Przelewy24 Payments: If the Customer chooses payment through the przelewy24.pl system, their personal data is transferred to the extent necessary for payment processing to PayPro S.A. with its registered office in Poznań.

§ 4 Cookies Mechanism, IP Address

1. The Online Store uses small files called cookies. They are stored by DONACO SP. Z O.O. on the end device of the person visiting the Online Store, if the web browser allows it.

Types of cookies:

  • Session cookies: deleted after the browser session ends
  • Persistent cookies: stored until they are deleted or expire

Own cookies used for:

  • authenticating the Customer in the Online Store
  • analysis and research and audience auditing

External cookies used for:

  • promoting the Online Store through Instagram service
  • promoting the Online Store through Facebook service
  • collecting statistical data through Google Analytics

Cookie management: Customers have the ability to limit or disable access of cookies files in their browsers. If cookies are disabled, using the Online Store will be possible, except for functions that inherently require cookies files.

§ 5 Rights of Data Subjects

Your rights:

  • Right to withdraw consent - at any time
  • Right to object to data processing
  • Right to data erasure ("right to be forgotten")
  • Right to restriction of processing of data
  • Right of access to data - receiving a copy of data
  • Right to rectification of data - correction of incorrect data
  • Right to data portability - receiving data in CSV format

Request processing time: DONACO SP. Z O.O. fulfills requests without delay, but no later than within one month of receiving it. In case of complex requests, the deadline may be extended by an additional two months.

Complaints: The Customer has the right to lodge a complaint with the President of the Office for Personal Data Protection regarding violations of their personal data protection rights.

§ 6 Security Management - Password

1. DONACO SP. Z O.O. provides Customers with a secure and encrypted connection when transmitting personal data and when logging into the Customer Account. DONACO SP. Z O.O. uses SSL certificate.

2. In case of loss of access password, the Online Store enables generation of a new password. DONACO SP. Z O.O. does not send password reminders - passwords are stored in encrypted form.

Important: DONACO SP. Z O.O. never sends any correspondence requesting login credentials, especially the Customer account access password.

§ 7 Privacy Policy Changes

1. The Privacy Policy may be changed, about which DONACO SP. Z O.O. will inform Customers 7 days in advance.
